Can I take down or install a fire escape without a permit?

The answer is a resounding NO. Fire escapes, whether detached or attached to a property, must be approved by the local construction official and/or zoning authority. In New Jersey, permit applications require the submission of two forms for approval: the U.C.C F-100 and F-110 Building Subcode. These forms must be submitted by the property owner or the licensed contractor performing the work. Property owners are also responsible for ensuring that the fire escape is a requirement for the property's means of egress. It is unlawful to change or remove a legal means of egress from a multiple dwelling without approval from both the construction and fire subcode officials.

Licensed contractors must submit a structural or architectural drawing along with the permit application, showing plans for the new fire escape. These plans should include attachment details, footing details, ladder, stair, and landing details, as well as zoning-relevant information such as property size and neighboring buildings or obstructions. Scalability is required on all plans, along with elevation drawings. A registered and licensed engineer or architect must provide a raised ink seal on all pages of the plans, along with full contact information on both permit application forms.

The overseeing engineer will be required to provide final sign-off or request final construction approval for the fire escape installation. Inspections must be conducted to properly close out the permit application. If footings are included in the plans, a footing inspection will also need to be scheduled in advance.
